Birchway Point Bookings LLC publishes this site from Greensboro, NC. Reading it, or sending a request through it, means these ten clauses apply to you.

Nothing on this site can be bought. Every dollar figure between $1,890 and $4,450 is an estimate for a request, not an offer.

Booking here means this office places the reservation with the company that runs the trip. Nothing is paid to us, no card is held, and there is no checkout anywhere on this site.

The request form takes bookings 24/7 and keeps no closing time. A person opens what arrives before the working day ends.

PublisherBirchway Point Bookings LLC publishes this site and every page under this domain, and is contactable at 324 West Wendover Avenue, Greensboro, NC 27408, by telephone at (336) 680-4173, and in writing at overland@birchwaypoint.com. the North Carolina Secretary of State holds the registration for the company. Where these terms say we, us or the office, they mean Birchway Point Bookings LLC and nobody else.
  2. Two. What this company isBirchway Point is an independent booking office for vacation travel. It is not an airline, a hotel, a cruise line, a rail company, a tour operator or a resort, and it does not own, staff, drive, fly, sail or run anything you travel on or sleep in. Every trip described here is carried out by a separate operating company. We arrange the reservation with that company on your behalf, and that company pays us a commission after you have traveled. You are charged nothing by us at any point.
  3. Three. Nothing on these pages is for saleThere is no checkout here, no cart, no payment page and no card field, and it never will while it is under our control. Prices shown in the catalog are per person, in United States dollars, based on two adults sharing, and they move with season, airfare and how many people are traveling. A published figure is an estimate that tells you the size of the trip. It is not an offer capable of acceptance, and no click on this site creates a contract of any kind.
  4. Four. When a booking existsSending a request creates nothing. We read it, we go to the operating company, and we come back to you in writing with what that company will actually hold, at what price, on what deposit terms and by what date. A booking exists only when you have accepted that written figure and the operating company has confirmed it and taken its deposit directly from you. Until all three of those things have happened, you hold no reservation, whatever a page on this site says.
  5. Five. Whose rules govern the tripThe contract for the travel itself is between you and the operating company. Its booking conditions, deposit schedule, change fees, minimum numbers, age rules and cancellation ladder govern the trip, not this page, and where the two ever appear to disagree, the operator's document wins. We will send you those conditions in full before you accept anything, and we will read them with you if you would rather have them explained by telephone.
  6. Six. What the four tiers mean and do not meanTrips on this site are filed by how much notice they need: short notice, one season, most of a year and two winters. Those labels describe when an operating company usually opens its book, and how long its inventory has historically lasted. They are a planning tool. They are not a promise that a departure exists on any particular date, that a specific room, cabin, seat or guide will be free when you ask, or that the tier will still be accurate next year. Operators change their release calendars without telling us.
  7. Seven. Who carries the risk when a release date passesIf an operating company opens its book late, opens it smaller than usual, sells out before we reach it, cancels a departure or does not open the year at all, the loss falls where the operator's own conditions put it. We do not stand behind an operator's inventory and we cannot compel one to hold space. What we will do is tell you the same working day we learn of it, put the alternatives in front of you in writing, and take you through them at no charge.
  8. Eight. What this office answers forthis desk answers for what it does itself: passing your instructions to the operating company accurately, telling you what its conditions say, and not making things up. If we get that wrong and it costs you money, our responsibility is limited to putting right the error we made, and in no event does it extend to the operator's performance, to weather, strikes, mechanical failure, border closures, illness or any other matter outside the arranging of a reservation. Nothing here limits any liability that cannot lawfully be limited.
  9. Nine. What you answer forYou answer for giving us names exactly as they appear on the travel document you intend to use, for correct dates of birth, for a reachable telephone number and mailing address, for reading the operator's conditions before you accept them, and for paying the operator on its schedule. You also agree not to scrape, copy, republish or resell the text and photographs on this site, which are ours, and not to send requests you have no intention of pursuing.
  10. Ten. Which law appliesThese terms are governed by the laws of the State of North Carolina and by the federal law of the United States. A dispute arising out of them belongs in the state or federal courts sitting in North Carolina, and both sides consent to that. If one clause above is found unenforceable, the other nine stand unchanged.

Things you will not find under this domain

A checkout, cart or payment page
There is none. Money moves between you and the operating company, never through us.
A stored card
We do not take card numbers by telephone, by mail or through the form, and we have nowhere to keep one.
Insurance, visas or passports
We do not sell, arrange, recommend or comment on any of the three. Ask the issuing authority or a licensed broker.
A verdict on whether a place is safe
We do not publish one, and we will not give one on the telephone either. Consult the sources that exist for that purpose.
A rating, a star or a customer review
We publish none. Where you see a number on this site it is a price, a duration or a lead time.
A named operator, resort or carrier
The catalog describes trips by type, standard and season. The company that runs yours is named in the written figure we send you.

Payment, refunds and everything that follows from taking no money

Payment
Nothing is payable to Birchway Point Bookings LLC. Deposits and balances go directly to the operating company on its own schedule, and its receipt is your proof of payment.
Refunds
We hold none of your money, so we can refund none of it. A refund is claimed under the operator's cancellation ladder, and our side of it is written work we do for you at no charge. See the cost of pulling out.
Returns and exchanges
Nothing physical is sold here, so there is nothing to return. A change of date or party size is handled as an amendment under the operator's conditions, which usually carry a fee.
Delivery
Nothing is shipped. Confirmations, conditions and the written figure arrive by electronic mail, and two to four working days go by before the figure does to prepare.
Recurring charges
There is no subscription, membership, retainer or standing charge anywhere in this arrangement, and we will never set one up on your account.

Firms other than this one

The catalog pages carry no third party names, and no page under this domain shows anybody else's mark or logo. Links off this site are rare and always labeled. When you follow one, you leave our control entirely: the other firm's terms and its handling of your information apply from that moment, and we cannot answer for what it publishes or how it behaves.

One change is planned openly rather than sprung on you. A fare lookup tool may in future sit on a subdomain of this site, run by a company that is not Birchway Point Bookings LLC. If it appears, it will carry its own disclosure naming the firm behind it and explaining that a booking made through it is a contract with that firm and not with us. Nothing here would move: this office would still take no payment, hold no card and run no checkout, and the terms above would go on governing everything you send to overland@birchwaypoint.com or say to somebody at (336) 680-4173.

Requests submitted through the form on this site are accepted There is no attendance timetable on this site and there will not be one. Hours on a door answer a question nobody is asking, which is whether a human being happens to be sitting down at this moment. The question that matters is how long you wait for something useful. So: the request form is awake 24/7 and shuts for nothing, whatever lands in it is opened by a person before that working day is out, and a number against your own dates takes two to four working days because a second company has to answer first. No figure is guessed at to make the wait shorter., and a message is read looked at before the working day ends. That is a statement about the form, not about a person waiting by a telephone.

Amendments to this page

We rewrite these clauses whenever the working method shifts, and whatever stands here now is what governs to a request sent today. We do not backdate. If a clause changes after you have sent us a request but before a booking exists, the wording that stood on the day you sent it governs that request, and we will tell you plainly if the difference matters to you. A booking already confirmed by an operating company is unaffected by anything we do to this page, because that contract lives with the operator.

If a clause here reads as though it contradicts something on what people ask before they commit or the order the work happens in, this page is the one that governs, and we would like to know about the contradiction so we can fix the other page.
